Court Reportedly Limits Federal Ban on Firearm Ownership by Marijuana Users
The United States Supreme Court has ruled unanimously (9-0) in favor of Ali Danial Hemani, a Texas marijuana user and Pakistani-American dual citizen. The court held that a 1968 federal law barring illegal drug users from owning firearms, as applied to cannabis users, violates the Second Amendment. Backed by a rare alliance of pro-gun and civil liberties groups like the ACLU, the ruling narrows the federal government's authority to restrict gun access for drug users. While the Trump administration argued the law was necessary—comparing it to historic bans on "habitual drunkards"—Justice Neil Gorsuch noted that the government's own relaxation of cannabis policies undercuts its claims that regular marijuana users are categorically dangerous. However, the ruling specifies that the government can still legally prosecute individuals who are actively intoxicated or addicted to harder drugs.
